There are lots of children who are in homes with their biological parents that are not "in their best interest". The entire juvinile court system is based on family reunification, which many times is not "in the best interest of the children" from an outsider's perspective. However, parents have rights to their children. Why in the world is the Supreme Court bothering themselves with this case, when the lower courts have been incredibly clear. If you read the Supreme Court hearing transcript you can see that the Cherokee Nation was not properly notified. Why give the child to adoptive parents when her father, who is more than capable of providing for her, wants her?
