If the child is born in California and the Adoptive parents are in Colorado, can the adoptive parents be over 50?
Yes, adoptive parents who are over 50 may adopt no matter what state the child is born in or the adoptive parents live in. It is important, however, to work with an agency in Colorado and California that do not discriminate against adoptive parents that are over 50. Many agencies will not work with adoptive parents over 50 even though this is not prohibited by law.
In California, you would work with the Independent Adoption Center as we do not have any discriminatory policy for adoptive parents, including age. In Colorado, you will need to find an adoption agency with similar policies. At IAC we work with families in all states, we would help you find a local agency to complete your homestudy.
